Toby’s involvement in mock trial began when his parents forced him to try out for his high school team. An early subscriber to the publication, If You’re Going To Do Something, You May As Well Be Freakishly Obsessed With It, mock trial has been consuming his life ever since.

While in college, Toby was one of the founders of Macalester's mock trial team -– a group with at least three dubious distinctions: (1) the last team to win the “Silver Flight” tournament without receiving a bid to the National Championship Tournament; (2) the first (and still one of two) to go 8-0 at the National Championship Tournament without advancing to the final round; and, most importantly, (3) single-handed responsibility for the creation of AMTA-assigned team numbers given their repeated decision to compete using "666". (No, that is not a joke.)

Having spent six years doing basically nothing but mock trial, Toby took a bunch of years off. Resistance was indeed futile and, well, here he is.

In his spare time, Toby teaches Civil Procedure, Civil Rights Litigation, and the Supreme Court Litigation Clinic at UVa Law School. He is a former law clerk to Chief Judge Edward Becker of the U.S. Court of Appeals for the Third Circuit and Justice Ruth Bader Ginsburg of the U.S. Supreme Court. From 2007-2010, he was an Assistant to the Solicitor General of the United States (including a year working for now-Justice Elena Kagan), during which he argued six cases before the U.S. Supreme Court. Toby is currently serving as the Solicitor General of Virginia, and is also a member of the board of directors of the American Mock Trial Association. He also watches a ridiculous amount of TV.
